1. About Aquavistas
Aquavistas provides a web-based platform for managing performer availability and show booking requests. The platform is intended for use by event organisers and registered performers across a range of entertainment disciplines.
2. Eligibility
You must be at least 18 years of age to use this platform. By using Aquavistas, you confirm that you meet this requirement and that all information you provide is accurate and truthful.
3. Use of the Platform
You agree to use the platform only for its intended purpose — managing legitimate show bookings and performer availability. You must not:
- Submit false, misleading, or fraudulent information;
- Use the platform for any unlawful purpose;
- Attempt to gain unauthorised access to any part of the platform or its underlying systems;
- Disrupt or interfere with the platform's operation;
- Reproduce or redistribute any content from the platform without our permission.
4. Booking Requests
Submitting an availability or booking request through the platform does not constitute a binding contract. A booking is only confirmed when both parties (the organiser and the performer) have agreed to the terms of the engagement separately. Aquavistas acts as a coordination tool only and is not a party to any agreement between organisers and performers.
5. Performer Responsibilities
Performers using the platform are responsible for keeping their availability up to date and responding to requests in a timely manner. Aquavistas accepts no liability for losses arising from missed communications or inaccurate availability information.
6. Intellectual Property
All content on the Aquavistas platform, including design, text, and software, is owned by or licensed to Aquavistas. You may not copy, reproduce, or distribute any part of it without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Aquavistas shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the platform, including but not limited to lost bookings, loss of income, or data loss. Our total liability to you shall not exceed £100.
8. Availability of the Platform
We aim to keep the platform available at all times but do not guarantee uninterrupted access. We may suspend or withdraw the platform at any time for maintenance, updates, or other reasons, without prior notice.
9. Third-Party Links
The platform may contain links to third-party websites. We are not responsible for the content or practices of those sites and encourage you to review their privacy and terms policies independently.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
